Terms of Use:

1. INTRODUCTION

This document is an electronic record under the Information Technology Act, 2000 and applicable rules. It governs the use of services provided by Veeway Infotech Private Limited through the V Way Taxi platform. 

By accessing or using the platform, you agree to be bound by these Terms.

2. PLATFORM ROLE (IMPORTANT LEGAL POSITION)

V Way Taxi is a technology platform and intermediary only that connects:

  • Customers
  • Drivers
  • Vendors / Businesses

The platform does not own, operate, control, or provide transportation or logistics services.

All transactions are strictly between users and service providers.

3. USER ELIGIBILITY

Users must be legally capable of entering contracts under Indian law. Minors are not permitted to use the platform independently.

4. USER ACCOUNT & RESPONSIBILITIES

  • Users are responsible for maintaining account confidentiality
  • All activities under the account are user responsibility
  • Providing false information may lead to suspension

5. NATURE OF TRANSACTIONS

  • V Way Taxi only facilitates discovery and connection
  • All terms (pricing, service quality, timing, delivery, etc.) are agreed directly between users and drivers/vendors
  • The platform is not responsible for execution of services

6. PAYMENTS

  • Payments may be processed via third-party payment gateways
  • V Way Taxi does not store banking/card data
  • Any fraud or unauthorized transaction is the user’s responsibility

7. CANCELLATION & REFUNDS

  • Governed by respective driver/vendor policies
  • V Way Taxi only forwards requests and does not guarantee refunds

8. CONTENT & LISTINGS DISCLAIMER

  • Content is provided by third parties (drivers/vendors/users)
  • V Way Taxi does not guarantee accuracy, legality, or authenticity
  • Users must verify details independently

9. LIMITATION OF LIABILITY

V Way Taxi shall not be liable for:

  • Service failure or delays
  • Accidents or damages
  • Loss of goods or personal belongings
  • Misconduct by drivers/vendors
  • Any direct or indirect losses

10. INDEMNITY

Users agree to indemnify V Way Taxi against:

  • Legal claims
  • Disputes with other users
  • Misuse of platform services

11.1 Trip Sharing Feature (Passenger & Goods)

  1. Platform Role
    V Way Taxi only enables users to share trips. It does not operate or manage rides.
  2. Direct Agreement
    All trip-sharing arrangements are strictly between users (driver/passenger/goods sender).
  3. Risk Acknowledgement
    Users accept all risks including:
    • Safety risks
    • Delays
    • Goods damage/loss
  4. No Liability
    V Way Taxi is not responsible for:
    • Accidents
    • Disputes
    • Service quality
  5. Pricing
    Fare sharing is mutually agreed. Platform does not regulate pricing.
  6. Legal Compliance
    Drivers must comply with transport laws, permits, and insurance.

11.2 Business Directory Listings

  1. Informational Purpose Only
    Listings are for discovery and informational use.
  2. No Endorsement
    Listing does not mean verification or recommendation.
  3. User Responsibility
    Users must verify business details before engagement.
  4. Third-Party Transactions
    All dealings are directly between users and businesses.

11.3 Top Premium Business Listings

  1. Paid Promotion Feature
    Premium listings provide higher visibility.
  2. No Guarantee
    V Way Taxi does not guarantee:
    • Leads
    • Bookings
    • Revenue
  3. Ranking Logic
    Listings may be displayed based on:
    • Subscription level
    • Relevance
    • Internal algorithms
  4. Non-Refundable Fees
    Subscription fees are non-refundable unless stated otherwise.

11.4 Vendor Mini Website (Shareable Link)

  1. Feature Description
    Vendors can create a shareable mini website hosted on the platform.
  2. Vendor Responsibility
    Vendors are fully responsible for:
    • Content accuracy
    • Pricing
    • Legal compliance
  3. No Transaction Liability
    All enquiries or deals are between vendor and customer.
  4. Hosting Role Only
    V Way Taxi only provides hosting infrastructure.
  5. Content Control Rights
    Platform may remove content that:
    • Violates laws
    • Misleads users
    • Receives complaints

11.5 General Disclaimer for All New Features

  • V Way Taxi is not a service provider, agent, or broker
  • It only provides a digital platform for connection
  • All liabilities rest with transacting parties

11.6 Indemnity for New Features

Users (drivers/vendors/customers) agree to indemnify V Way Taxi against:

  • Trip sharing disputes
  • Business listing inaccuracies
  • Vendor website claims
  • Customer complaints

11.7 Feature Modification Rights

V Way Taxi reserves the right to:

  • Modify or discontinue features
  • Change pricing models
  • Update policies without prior notice

12. GOVERNING LAW & JURISDICTION

  • Governed by Indian law
  • Jurisdiction: Coimbatore, Tamil Nadu

13. ARBITRATION

Disputes shall be resolved under the Arbitration and Conciliation Act, 1996.

14. FORCE MAJEURE

V Way Taxi is not liable for delays due to events beyond control (natural disasters, government actions, etc.).

15. ENTIRE AGREEMENT

This document constitutes the full agreement between users and V Way Taxi.
